Before: KEITH and JONES, Circuit Judges, and BATTISTI* Order Appellant Edward Stacey filed a pro se action in the district court below, individually and as representative of the class of all residents of Montgomery County, Ohio, against the President of the Dayton Law Library (also referred to as the Montgomery County Law Library). Stacey alleged that his first amendment and fourteenth amendment rights had been violated by the library's refusal to allow him access. He sought review under 42 U.S.C. § 1983. The district court dismissed the action on lack of jursidiction grounds, and appellant appealed to this court. The library was established for the benefit of members of the Ohio General Assembly, County Officers, and state and local judges. See Ohio Revised Code § 3375.48. The library also allows local lawyers to become members of the Library Association by paying $10 annual dues. Visiting lawyers and law students may use the library without paying a fee. The library does not allow lay persons to use its facilities. Funds for operating the county library are provided from fines, bail forefitures and recognizance.
